The state registration of a land parcel as an object of land legal relatioships: the definition and the legal nature

The article contains the findings of the conducted research on the legal nature of the state registration of a land parcel, realization of the state registration of a land parcel in accordance with the general theory of law and realization of law as an activity aiming to use, performing, aligning and application of the legal norms, defined the general and the generic features of this legal phenomena with the use of the scientific research methods particularly analysis, synthesis and deduction at theoretical and empirical levels. The author finds out the conclusion that the state registration of the land parcel should be considered as multi-elemental phenomenon of a legal reality and considering the main function of law it aims to regulate the social relationships. The mentioned legal phenomenon appears in an abtract way (at the level of the legal idea and principles of state registration of a land parcel), at the concrete level – in the form of positive norms, in the form of materially concrete definitions – for example, as court decisions, as well as as socially objectified embodiment – as a positive legal behaviour of relevant subjects. The article contains argumentation that the legal nature of the state regislation of the land parcel means the researched object is a multi-elemental phenomenon, inter alia, a legal regime, the mechanism of a legal regulation, legal relationship, a legal fact, and a land procedure. The author defines the features of the land registration of the land parcel, particularly: 1) it is a land procedure; 2) it is conducted by a state cadastre registrator; 3) it is conducted according to the established terms and to the regulated stages; 4) it is done only after the application is provided by the person or legal entity having the rights for it taking into account the land documents. In the article the author provided her own definition of the state registration as a land procedure being conducted by the state cadastre registrator after the owner or user of the land parcel files an application and aims to insert information about the land parcel to the State Land Cadatre and ensures provision of the cadastre number to the land parcel.
